Sexual Violence Policy

1. Purpose & Scope
Canadian International Career College (CICC) is committed to fostering a learning and working environment free from sexual violence and harassment. This policy specifically addresses sexual violence involving students enrolled at CICC, in accordance with section 32.1(2)(a) of the Career Colleges Act, 2005.
This policy applies to all students, staff (including faculty, administration, contractors, and volunteers), visitors, and third-party providers at our Scarborough campus (1691 McCowan Rd, 2nd Floor, Scarborough, ON M1S 3E6), and to all college-sponsored events and placements.
2. Legislative Authority
This policy is adopted in accordance with the Career Colleges Act, 2005 and Ontario Regulation 415/06, which require all career colleges to maintain and publicly post a stand-alone sexual violence policy.
3. Definitions

Consent: A voluntary, conscious, and ongoing agreement to engage in specific sexual activity. Silence or passivity does not constitute consent.

Sexual Violence: Any sexual act or act targeting a person’s sexuality, gender identity or gender expression, whether physical or psychological in nature, committed, threatened or attempted against a person without consent. Includes sexual assault, harassment, stalking, voyeurism, exploitation, cyber-harassment, and indecent exposure.

Sexual Harassment: Unwelcome sexual comments, gestures, or actions that a reasonable person would find offensive, humiliating, or intimidating.

Sexual Misconduct (Employee): As defined in s. 32.0.1 of the Act, includes sexual advances, touching, sexual relations, or reprisals by employees toward students that violate the Criminal Code, Human Rights Code, or CICC policies.

Complainant: The individual reporting or impacted by the incident.

Respondent: The individual alleged to have committed misconduct.

Disclosure: Sharing of information about sexual violence for the purpose of receiving support, without initiating an investigation.

Formal Complaint: A documented report made to the Sexual Violence Response Coordinator (SVRC) requesting an investigation.
4. Guiding Principles

Survivor-Centred & Trauma-Informed: We prioritize autonomy, dignity, and choice, while aiming to minimize re-traumatization.

Confidentiality: Information is shared only on a need-to-know basis, with records stored securely and separately.

No Cost: There is no cost to report incidents, participate in investigations, or receive accommodations.

Proportionate Disciplinary Action: Violations may result in discipline, up to and including dismissal or expulsion, based on severity and findings.
5. Contacts (Designated Roles)
The College is committed to appropriately accommodating the needs of students affected by sexual violence. This may include academic accommodations, access to counselling, safety planning, schedule changes, or other supports as needed. Students seeking accommodations may contact the Sexual Violence Response Coordinator (SVRC) listed above, who is responsible for arranging these supports.

6. Reporting, Investigation & Timelines

Reporting: Incidents may be disclosed informally or reported formally to the SVRC by email or in person.

Intake Meeting: Held within five (5) business days of disclosure or complaint.

Interim Measures: May include no-contact orders, escorts, leave, schedule changes, or placement adjustments.

Investigation: Conducted by a trained, impartial investigator using trauma-informed and procedurally fair practices, and completed within 45 calendar days.

Decision: Based on the balance of probabilities and issued within 90 calendar days.

Appeal: Either party may appeal within 14 calendar days; extensions of up to 30 days with written notice.
7. Investigation Procedures

Both parties will be interviewed and may bring a support person or advisor.

Irrelevant questioning about prior sexual history or expression is prohibited.

Either party may request alternative arrangements to avoid face-to-face contact.

Status updates will be provided throughout the process.
8. Protection from Retaliation & Discipline

No disciplinary action will be taken against individuals who report in good faith, even if alcohol or drugs were involved.

Retaliation is strictly prohibited and grounds for discipline.
Sanctions may include:

Students: Warnings, probation, suspension, expulsion.

Staff: Reprimands, suspension, termination.
9. Support Services & Accommodations
In accordance with O. Reg. 415/06, CICC will appropriately accommodate the needs of students affected by sexual violence, including academic, emotional, and safety-related needs, as outlined below.

10. Training & Awareness
Annual mandatory training for all staff, instructors, and volunteers, covering:

Training is delivered in-house and tracked by Student Services.
11. Posting & Communication

This policy is publicly posted on the CICC website.

It is included in all student enrolment contracts, in accordance with the Act.
12. Privacy & Record-Keeping

Records are retained securely for a minimum of seven years.

Information is disclosed only with student consent or as required by law (e.g., imminent harm), in compliance with FIPPA.
13. Policy Review & Student Input

Reviewed at least once every three years, or sooner as needed.

Student input is actively solicited during all reviews, in accordance with s. 32.1(5) of the Act.
14. Compliance & Data Reporting
CICC collects and reports required data to the Superintendent as per s. 32.1(8)-(11), including:

Number of incidents and complaints

Services and accommodations provided

Awareness initiatives

Effectiveness of the policy
No personal information will be disclosed, in accordance with FIPPA.
CICC may be required to conduct student surveys at the direction of the Superintendent.
15. Employee Sexual Misconduct Policy
Employees are prohibited from:

Engaging in sexual relations or sexual behaviour with students
-
Making sexual comments, advances, or reprisals
Disciplinary measures for violations include immediate dismissal without entitlement to notice or compensation.
An employee dismissed for sexual misconduct shall not be re-employed.
All agreements related to allegations must meet the criteria in s. 32.0.1(6), including student legal counsel and consent to confidentiality.
This section satisfies s. 32.0.1(8) of the Act.
16. Exclusion from General Complaints Process
Sexual violence incidents are addressed exclusively under this Sexual Violence Policy.
These matters are not handled through the general student complaints procedure under s. 31 of the Act.
