
1. Title
Sexual Violence and Harassment Policy
2. Purpose
To ensure every student and staff member at Canadian International Career College learns and works in an environment free from sexual violence and harassment. This policy sets out trauma‑informed, survivor‑centred procedures for reporting, investigating, and resolving incidents, in full compliance with the Private Career Colleges Act, 2005 and its regulations.
3. Scope
This policy applies to all students, staff (including faculty, administrators, support and contract personnel), volunteers, and third‑party providers at the Scarborough campus (1691 McCowan Rd, 2nd Floor, Scarborough, ON M1S 3E6) and to all College‑sponsored events and activities, whether on‑ or off‑site.
4. Legislative Authority
This policy is adopted under the Private Career Colleges Act, 2005 (S.O. 2005, c. 28, Sch. L) and O. Reg. 415/06, which require every private career college to maintain a stand‑alone policy addressing sexual violence and harassment and to post it on its website.
5. Definitions

Consent: A voluntary, conscious, ongoing agreement to engage in specific sexual activity. Must be affirmative and can be withdrawn at any time. Silence or lack of resistance does not constitute consent.

Sexual Violence: Any non‑consensual sexual act or act targeting sexuality, gender identity or expression, whether physical or psychological (including assault, harassment, stalking, voyeurism, exploitation, and cyber‑harassment).

Sexual Harassment: Unwelcome comments, gestures, or actions of a sexual nature that a reasonable person would foresee as offensive, humiliating, or intimidating.

Zero Tolerance

Any finding of sexual violence or harassment will result in disciplinary action up to expulsion or dismissal.

8. Reporting Options & Timeline

Intake:

Formal reports submitted to the SVRC by email or in person.

Intake meeting scheduled within 5 business days of report.

Interim Measures:

“No‑contact” orders, campus escorts, leave of absence, or other supports as needed.

Investigation:
-
Conducted by a trained, impartial investigator.

Completed within 45 calendar days of intake.

Decision:
-
Issued on a “balance of probabilities” standard within 90 calendar days of the initial report.

Possible sanctions: warning, probation, suspension, expulsion (students); reprimand, termination (staff).

Appeal:

Either party may appeal to the Appeals Officer within 14 calendar days of the decision.

Extensions of up to 30 calendar days may be granted with written notice to both parties.
